Photomart Web Terms and Conditions
Use of any Photomart website signifies your agreement to be bound by
all our terms and conditions.
Photomart is a trade wholesaler. By placing an order through a
Photomart website you are signifying that you are a trade customer,
offering to make a business-to-business purchase, bound by our terms
and conditions. Photomart does not make offers of sale to consumers.
Prices displayed on Photomart websites are web prices, meaning they indicate the nett price after settlement that we may offer goods at for purchase through the web. They do not indicate the prices of goods ordered from Photomart through any other channel, except where otherwise stated. Prices exclude VAT, carriage and delivery insurance, where applicable, except where otherwise stated.
The display of items and prices on Photomart websites may be an invitation to treat, but is never an offer of sale. The taking and accepting of your credit card details or details of other payment method on Photomart websites does not signify our acceptance of your offer to buy. We may not charge your credit card at the time our websites accept it. We may respond to your offer to buy with a proposal to sell to you that differs from your original offer. Any offer of sale ultimately made by Photomart is made only on the understanding that the sale is governed by our terms and conditions.
You agree to accept responsibility for everything done using your
Photomart website accounts, whether done by you or by someone else. It
is your responsibility to control access to your accounts on Photomart
websites. In particular you must keep your account details, including
passwords, private. You must also keep the computers you use secure.
If ever you know, or suspect, that another person may have information
which might allow them to make unauthorized use of any of your
accounts, you must tell us at once.
You are responsible for providing accurate information when setting up
your accounts on Photomart websites, and for keeping that information
up to date. Photomart cannot be liable for any errors that occur
because the account information you provided is inaccurate, or has
become out of date.
You are responsible for the conduct of your accounts on our websites.
It is not an acceptable use of an account for it to be used in any way
that is detrimental to the operation of the site, or its use by others.
It is your responsibility to ensure that your account is not used in
any way for any unlawful purpose. Photomart does not tolerate the use
of an account for any malicious, offensive, or otherwise injurious,
activity, whether intended or not.
Photomart cannot filter all content in advance for possible or
inadvertent defamation, but will endeavour to take down any material
which may be defamatory in reasonable time, once it has been brought to
our attention.
Although we make a best effort in good faith to serve our customers,
Photomart cannot guarantee to provide anyone with access to our
websites, whether they have login accounts or not. Nor do we guarantee
to accept orders placed through our websites. We reserve the right to
refuse access, close accounts, and cancel orders, without notice or
explanation.
Although we aim for high levels of availability, Photomart websites may
become unavailable at any time, for any duration, for any reason and
without notice, and transmissions to and from them are not guaranteed
to be uninterrrupted or error-free.
You are permitted to make limited use of our websites because we grant
you
limited licence to do so. This does not extend to permitting downloads
of any of our website material (other than by bona fide automatic
browser
caching), except downloads we have explicitly allowed. Our websites,
and all of their displayed content and underlying computer code, are
copyright material, with all rights reserved. You may not copy them or
make derivative uses. You may not access our data for unauthorised use
in other applications.
Photomart General Terms and Conditions
• Goods are not supplied on a
trial
basis.
• All prices quoted are
the nett price after settlement (NAS), exclusive of carriage, insurance, and V.A.T., unless otherwise stated.
• Certain products have
minimum system or configuration requirements. We suggest if you are
unsure of what these are, that you contact us, or the manufacturer,
prior to purchase, since we do not take
back, for
refund
or exchange, any opened items that are suitable for the purpose
intended, but have been ordered in error.
Unless we are specifically asked
about requirements or compatibility, we shall assume the customer is
aware of what these are.
• If we have to part-ship
an
order, due to a temporary stock shortage, carriage is only charged on
the first
consignment. Subsequent part shipments will
not carry a delivery charge. We will always try to let you know if an
item is out of stock when you place your order. If, however, you order
new release items we shall hold the order until all items are in stock,
unless you agree to pay a shipping charge per item sent.
• Prices and promotional
offers are
subject to change without notice. Discounts and special offers are not valid in conjunction with any other offer or discount, and are not available on finance.
• Access, Mastercard and
Visa
Credit Cards are accepted without surcharge, however, we do reserve the
right to deliver only to
the cardholder‘s billing address, or other address acceptable
to the card issuer.
• Connect, Solo and
Maestro
(Switch is being replaced by Maestro) debit
cards are cleared immediately, however, we
do reserve the right to
deliver only to the cardholder‘s
billing address,
or other address acceptable to the card
issuer.
• Your credit/debit card
is
not usually charged until the day your order is shipped. However, there may be exceptions to this.
• Personal and business
cheques may be accepted as payment by prior arrangement, but will need to be cleared before any goods are
shipped. This takes 8 working days from when we receive the cheque. Bankers Drafts and Building Society
Drafts may also be accepted by prior arrangement , but will need
verification and
may take some time to clear. Postal orders are acceptable and are
cleared immediately. You may also transfer funds directly into our bank
account, in which case goods can be shipped straight away. Please
telephone to obtain the details and procedures.
• You may ask for your
cheque
to be presented for express clearance, however a £10+VAT fee
will be charged for this service.
• Education and
Government
orders are acceptable subject to the institution’s acceptance
of our trading terms and conditions. Unless otherwise expressly
stipulated by the Company, credit account invoices are due and payable
in full 30 days after the invoice date. If an invoice becomes overdue,
we reserve the right to charge interest on
overdue amounts at 5% above Barclays
Bank Plc base
lending rate, from the time the amount becomes overdue until the
invoice is paid in full. Account Customer invoices will show prices 5% above catalogue prices. If the invoice is paid within 30 days this 5% surcharge is offset in full by our Settlement Discount.
• No property or title to
goods shall pass from the Company to the Customer until the full amount
of the value of the goods has been credited to the Company’s
bank account, however, the customer is responsible for the goods from
the time of delivery and liability to insure the goods then rests with
the customer.
• The Company reserves the
right not to
accept cancellation of orders or the return
of
unwanted goods, however, at the Company’s discretion, it may
be prepared to accept cancellations or returns subject to the payment
of a restocking fee of 15% (minimum amount £25) as long as any returned items are in a fully marketable condition, and any items specially ordered for the customer are likely to be saleable at full price to another customer in a reasonable time.
Cancellations must be made by the customer in writing, only after having called us, in advance, to obtain a
“Cancellation Number”.
• All products (including
special offers and promotions) are subject to availability and we do not guarantee to accept and fulfill any order.
• All products are
covered by
manufacturer’s warranty.
• The Customer’s
signature will be required at the time of receipt and goods cannot be
left without such signature.
• Claims for
non-delivery,
missing items or damage to goods in transit must be made within 3 working days of expected delivery. Claims will not be
accepted after this time.
• Acceptable orders which
have
been placed and credit cleared by 3.00pm weekdays will be dispatched
that day for expected delivery in Mainland UK during the next working
day, (barring system failures, etc. Some areas of the UK excluded).
• Photomart can accept no
liability for performance or late
delivery of goods supplied in any
circumstances.
• All illustrations and
product descriptions featured are for guidance only. Actual packaging
and product design may vary from those shown.
• We are not responsible
for
typographical errors.
Photomart Ordering Procedures
You may telephone your order
to
Photomart during business hours Monday
to
Friday. Orders can
also be placed via fax or the Photomart website 24 hours a day. If you
are paying by credit or debit card, please be aware that several credit
card companies will no longer authorise mail order transactions where
the goods are to be delivered to an address other than the
cardholder’s billing address, or to a person other than the
cardholder themselves. Bearing this in mind, if you do require delivery
to a different address or to another person, we would suggest you pay
by cheque or bank transfer. If you qualify for VAT exemption or VAT
relief, it is essential that the relevant certificate accompanies your
original order, to avoid delays in processing.
• Carriage charge in the UK
mainland (based on EX-VAT order value) is £10 for
orders up to £50, £5 for orders up to
£150, and FREE for orders of £150 and over (some
parts of northern Scotland excluded). For delivery to other areas or
countries or special timed deliveries please telephone for further information. Whilst every
effort will be made to deliver on time, we cannot be held
liable for late deliveries, nor can
refunds
be made.
In the unlikely event that
something
you purchase from Photomart should be defective, you should follow our
returns procedure. Simply call us and explain the problem. If we are
unable to assist you over the telephone and we believe there is a fault
with the item, we will issue you with a Returns Material Authorisation
(RMA) number.
You should then return the
item to us,
within three days of receiving the authorisation, complete with all
accessories, manuals and any protective packaging, clearly identifying the RMA number without defacing the
packaging. The customer is responsible for the cost of the
return carriage and in-transit insurance. On receipt of the
returned item, we will verify the fault and repair or replace the item
at our discretion.
If the item proves to be DOA,
“Dead on Arrival”, i.e. it has never worked from
the start, then providing it is returned (in accordance with the stated
procedures), within 14 days of receipt of the item, we will replace it
with a brand new item.
We cannot be held responsible
for any
damage caused due to poor packaging. Should the fault prove to have
been caused by misuse or anything not covered by the
manufacturer’s warranty, we will either return the item or
arrange to have it repaired at the customer’s expense.
We
will not accept or take
responsibility for any item returned other than by the stated procedure
or within the stated time. This Photomart guarantee does not affect
your statutory rights.
