EverCare Programme Contract

This contract outlines the terms and conditions of the EverCare Programme provided by Loukil LTD T/A Photomart (hereinafter referred to as "Photomart", "We", "Us", or "Our") to the Customer (hereinafter referred to as "You" or "Your"). By enrolling in the EverCare Programme, you agree to the following terms.

1. Programme Coverage

1.1. Worry-Free Protection

The EverCare Programme covers all dye-sublimation photo printers purchased from Photomart, regardless of brand or model, for the earlier of the time period or usage limit outlined in the Warranty Period Table (The “Coverage Period”). This ensures you are protected against any covered issues, provided the printer is used under normal conditions according to the manufacturer’s user manual.

1.2. Eligibility

The EverCare Programme is only applicable to dye-sublimation printers bought directly from Photomart and used within the United Kingdom. Coverage does not extend to printers purchased from other sources or used outside the UK.

1.3. Purchase Timing

The EverCare Programme must be purchased within 30 days of the printer purchase date. Failure to comply with this condition will render the programme unavailable for the said printer.

2. What is Covered

2.1. Manufacturer Defects

In the event of a manufacturer defect, Photomart will repair the printer free of charge, including parts and labour, provided the defect is reported within the coverage period.

2.2. Accidental Damage

If the printer is damaged due to accidental causes, Photomart will provide a clear repair quote. You may approve the repair at the quoted cost, or decline it, in which case a £120 + VAT diagnostic service fee will be charged and deducted from the deposit. These charges will also be applied if the printer is not packaged correctly, as per the information provided by the Technicians.

2.3. Loan Printer

During the repair period, Photomart will provide you with a loan printer of similar capabilities, free of charge. However, you must provide a refundable deposit for the loan printer, which will be returned once the loan printer is collected and inspected for damages.

2.4. Loan Printer Use

The loan printer will be available for use during the entire repair period. You will be responsible for providing your own printing media (ink and paper), as the loan printer does not come with these supplies. Any media provided with the loan printer must be returned, or you will be charged the full cost of the media.

2.5. Substitute Models

If your specific printer model is not available as a loan printer, Photomart may provide a substitute model with equivalent functionality. Substitute models may differ in features but will allow you to continue printing during the repair period. If media is provided with the substitute loan printer, you will be charged for it based on the cost per print, as listed in our current rates available online at https://www.photomart.co.uk/printers-media/event-printer-hires.html.

2.6. Collections and Deliveries

Photomart will arrange and cover the costs of collecting the faulty printer from your premises and delivering the loan printer. Once the repair is complete, we will arrange to collect the loan printer and return your repaired printer. If any printer is found to be damaged accidentally, or not shipped in the condition outlined by the Technicians, the customer will be liable to cover the delivery and collection charges at the rate of £30+VAT, which will be deducted from the deposit.

3. Programme Exclusions

3.1. Exclusions

  • Normal wear and tear of the printer.
  • Damage caused by improper installation, use of non-recommended media, or failure to follow the manufacturer’s operating instructions.
  • Cosmetic damage that does not affect printer functionality.
  • Any modifications, repairs, or attempts to repair the printer by unauthorised technicians.
  • Printers that have been used in industrial settings inconsistent with their intended design.
  • Damage caused by negligence, accidents, misuse, or acts of nature (e.g., floods, fires, power surges).
  • Failure to perform routine maintenance as specified by the manufacturer or improper storage conditions (e.g., exposure to excessive heat, humidity, or dust).
  • Problems arising from mis-operation or mis-configuration of other customer’s equipment such as computers, cameras, power generators, software, etc.

4. Loan Printer Conditions

4.1. Loan Printer Condition

The loan printer must be returned in the same condition it was received. If the loan printer is damaged due to misuse, negligence, incorrect packing or any unauthorised repairs, the customer will be responsible for repair or replacement costs. The refundable deposit may be withheld to cover such costs.

4.2. Loan Printer Media

The loan printer will be provided without media (ink or paper). You must provide your own media for use with the loan printer. If the printer is returned without any media provided by Photomart, the customer will be charged for missing media.

4.3. Substitute Printer

If your exact printer model is unavailable, Photomart reserves the right to provide a substitute model with similar capabilities. You will be responsible only for the cost of media (ink, paper, etc.) used during the loan period, based on Photomart’s current market rate.

5. Customer Responsibilities

5.1. Proper Use and Care

You are responsible for the proper use, care, and maintenance of both your own printer and the loan printer during the coverage period, as per the manufacturer’s user manual. Any misuse, including the use of unauthorised media, may void the programme coverage and result in additional charges for repairs or replacements.

5.2. Timely Communication

It is your responsibility to notify Photomart immediately of any issues with your printer. Delay in reporting problems may result in further damage, for which Photomart will not be held responsible.

5.3. Return of Loan Printer

Upon completion of repairs, you are required to return the loan printer within three (3) business days. Failure to do so may result in additional charges, and Photomart reserves the right to deduct these charges at the weekly hire rate from the refundable deposit.

6. Repairs and Diagnosis

6.1. Expert Diagnosis

Photomart’s manufacturer-certified technicians will perform a thorough diagnosis of your printer. If the issue is a manufacturer defect, repairs will be conducted free of charge.

6.2. Accidental Damage Repair

If the issue is determined to be accidental damage, Photomart will provide a detailed quote for the cost of repair. You can either approve the repair or decline it. If you decline, a diagnostic fee of £120 + VAT will apply and be deducted from the deposit.

6.3. Non-Warranty Repairs

If the printer is out of warranty (as specified in the Warranty Period Table) or the issue is not covered by the manufacturer’s warranty, repair costs will be quoted. You will be required to approve the costs before repairs are conducted. If repair costs are declined, the diagnostic fee of £120 + VAT will be deducted from the deposit.

7. Limitations of Liability

7.1. Photomart’s Liability

Photomart will not be liable for any indirect, consequential, or special damages, including but not limited to loss of profits, business interruption, or damage to property or other equipment caused by the malfunction or downtime of the printer.

7.2. Loan Printer Liability

While using the loan printer, you are responsible for any damage caused to the unit. Photomart is not responsible for any losses, damages, or delays caused by issues with the loan printer.

8. Duration of Coverage

8.1. Coverage Period

The EverCare Programme provides coverage for the lesser of either one (1) year from the date of the printer purchase or the maximum print count outlined in the Warranty Period Table, whichever comes first.

8.2. No Extension of Coverage

The coverage cannot be extended beyond the initial period. Once the coverage expires—either due to reaching the one-year limit or the maximum print count—the programme will cease to be valid.

9. Support Hours

9.1. Normal Operating Hours

Photomart will provide services such as loan printer arrangements, collections, and repairs during normal business hours: Monday to Friday, 9:30 a.m. to 5:00 p.m.

9.2. Out of Hours Support

For issues occurring outside of normal operating hours, contact Photomart via email. Responses will be made during the next available business day.

10. Non-Refundable Service

10.1. Non-Refundable Clause

The EverCare Programme is a non-refundable service. Once the programme is purchased, no refunds will be provided, regardless of whether or not the services under the programme have been utilised.

11. Abuse of Programme

11.1. Tampering with Certificate

If the EverCare Programme certificate is tampered with, altered, or falsified in any way, the programme will be deemed void. In such cases, no refunds will be provided, and all claims under the programme will be rejected.

11.2. Single Use Per Printer Component

The EverCare Programme may only be exercised once per each specific part or component of the printer. Repeated claims for the same part will not be accepted unless it is demonstrated that a separate issue has arisen.

11.3. Misuse of Programme

If Photomart’s technicians determine that the customer is abusing the programme or making unreasonable claims, such as repeated or excessive claims that are not genuine, Photomart reserves the right to cancel the EverCare Programme. In such cases, the programme will be deemed null and void, no further claims will be accepted, and no refund will be given.

11.4. Full Payment Requirement

If payment for the EverCare Programme or any services quoted by Photomart have not been paid in full, Photomart reserves the right to void the contract. In such an event, the customer will not be entitled to any services under this programme, and any claims will be rejected.

12. Changes to Terms and Conditions

12.1. Notification of Changes

Photomart reserves the right to amend or update these terms and conditions at any time at our discretion. However, any material changes that may affect your rights or obligations will be communicated to you in advance, either by email or in writing. It is your responsibility to review the current terms and conditions prior to making any claims. 12.2. Acceptance of Changes

By continuing to use the EverCare Programme after changes have been made to the terms and conditions, you accept and agree to the updated terms. If you do not agree to the changes, you may cancel your participation in the programme by contacting Photomart. Upon cancellation of services, no refund will be provided.

13. Entire Agreement

13.1. Complete Agreement

This contract constitutes the entire agreement between Photomart and the customer regarding the EverCare Programme. No other oral or written agreements or promises will modify the terms of this agreement unless confirmed in writing by both parties, except where changes are made in accordance with Section 12. Photomart reserves the right to update these terms and conditions as specified in Section 12. It is the customer's responsibility to review the current terms prior to making any claims. The customer acknowledges that Photomart’s standard Terms & Conditions, available at https://www.photomart.co.uk/terms-and-conditions, form part of this agreement and shall apply unless expressly excluded or amended herein.

13.2. Governing Law

This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Limitation of Liability

14.1. Customer Liability

To the extent permitted by applicable law, Photomart’s liability under this programme is limited to the repair or replacement of the printer as outlined in this contract. Photomart is not liable for any incidental, consequential, or punitive damages arising from the use, performance, or failure of any printer covered under this programme. You agree to indemnify and hold harmless Photomart, its affiliates, and employees from any claims, losses, damages, or liabilities arising from your use of the EverCare Programme or the loan printer, including any claims brought by third parties.

14.2. Insurance Coverage

It is advisable for customers to maintain adequate insurance coverage for their equipment. Photomart's liability is limited, and we recommend that customers have insurance to cover any potential damages or losses.
