1. Status of Terms

  1. These terms, including the provisions of the various procedures, notes and other important information that are either hyper-linked to these terms or stated in relevant sections of this website, constitute a legal document ("the Agreement") which sets out the rights and obligations of you as a purchaser (“The Customer, "you" or “your”), and those of Loukil Ltd. t/a Photomart ("Photomart", "we", “our” or "us") in relation to the products offered by us via our showrooms, call centres, online shops or any other sales channels owned or operated by us. By submitting an order for the purchase of good(s) from Photomart you are agreeing to The Agreement and you re-affirm The Agreement every time you submit an order to Photomart.

2. Place of performance and applicable law

  1. Photomart is a company registered in CARDIFF (Registered March 2020, registration no.: 12506435) and makes no representation that any products referred to in any of Photomart’s promotional literature or websites are appropriate for use or available in any other locations outside mainland UK, Northern Ireland, the Channel Islands and the Isle of Man.
  2. For all orders to Photomart for the delivery of good(s) to destinations outside of mainland UK, Northern Ireland, the Channel Islands and the Isle of Man:
    1. All ownership, title and risk in good(s) will pass to you immediately at the point and time at which such goods are placed at your disposal at our premises in the UK;
    2. The prices payable for good(s) as set out on our promotional materials and websites are exclusive of UK VAT (unless stated otherwise), local taxes, import duties and clearances. You acknowledge and agree that Photomart has no liability to you in respect of any such taxes including VAT, duties or clearances which may become payable, after the good(s) have been placed at your disposal at our premises in the UK;
    3. You are solely responsible for compliance with local laws if and to the extent that local laws are applicable. You and Photomart each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of The Agreement;

3. Placing an order with Photomart

  1. Orders are subject to acceptance in terms of The Agreement.
  2. Photomart accepts orders from businesses, government, local authorities, schools, colleges, universities or any other institution or organisation, provided such parties accept the provisions of The Agreement.
  3. Photomart is a B2B business, therefore, all prices are excluding VAT. VAT will be added to all orders.
  4. When placing an order through our online store, and just prior to submitting such order, a notice will be displayed on your web browser containing important information such as a description, price and delivery charges of the good(s) or service(s) ordered.
  5. Confirmation of receipt of your order is not an agreement on our behalf of acceptance of such order.
  6. Acceptance of the order and subsequent fulfilment of the contract between you and Photomart occurs when the order is dispatched by us for delivery. We reserve the right not to accept your order subject, but not limited, to any of the following conditions:
    1. The total value of your order does not meet the minimum required order value;
    2. The price of good(s) quoted on the order by Photomart, were quoted incorrectly (see paragraph 3.8);
    3. You have exceeded your existing credit limit;
    4. Your account with us has expired or no longer exists;
    5. Your account or credit status has changed;
    6. You do not have sufficiently available funds;
    7. Your cheque has not cleared;
    8. We have reason to suspect theft or fraudulent transaction;
    9. Quotes that are longer than 5 business days old;
  7. Photomart shall not be liable to the Customer for any economic or financial loss or damage as described in paragraph 6.7 of The Agreement, should Photomart decide not to accept your order.
  8. Your order will be dispatched for delivery the same working day unless the order was received after the required cut off time as determined by us (in which case it will be dispatched the following working day) or unless we have notified you that we do not accept your order or if you have cancelled the order and subsequently notified us of cancellation (in which case the order you submitted to Photomart will not be dispatched).
  9. Subject to E & EO, the prices and description of good(s) supplied to you by the website www.photomart.co.uk will correspond to their prices and descriptions on our websites and to their prices and descriptions in our promotional literature at the time of printing. If at any stage this is found not to be the case, i.e. the price(s) of one or more of the goods you ordered has/have been quoted incorrectly in the shopping cart, we will put your entire order containing such good(s) on hold from delivery and make every reasonable effort to notify you of the correct prices and descriptions with an option of either rejecting the good(s) in question for a full refund or accepting the good(s) at the correct price.
  10. All prices displayed in our promotional materials and on our websites are shown excluding VAT unless stated otherwise in which case VAT will be displayed at the standard rate. Should the applicable VAT rate change, Photomart reserves the right to adjust retail prices accordingly. For items which are placed on back order, VAT will be charged at the applicable rate at the time of dispatch.
  11. Prices listed on the website www.photomart.co.uk are exclusive to web orders only. Showroom and telesales pricing may differ on certain products.
  12. Any back orders placed with Photomart, regardless of time taken to fulfil the order due to supplier issues, will be non-refundable.

4. Offers, Campaigns and Promotions

  1. Catalogue Offers – Our product catalogues may contain promotional codes which will remain valid until further notice. We advise you to call our sales team to validate any offers we have previously printed as they may be withdrawn at any time without notice.
  2. Email Campaigns – Our regular email marketing campaigns go to a permissible list of subscribers only that have chosen (via a double opt-in process) to receive such campaigns. Emails may contain promotions, reminders, or general notifications. You may opt-out at any time by clicking the unsubscribe link found in any email.
  3. Website Promotions – We have different types of shopping cart discounts on our website:
    1. Automatically applied discounts when your order reaches a specific condition such as “Buy X, Get Y Free”.
    2. Manually applied discounts when you quote or enter a valid coupon code before placing your final order.
    All current promotions are listed on our OFFERS page. Photomart retains the right to stop any promotion or offer at any time without notice.

5. Delivery

  1. Photomart can deliver worldwide provided procedures are strictly adhered to when you place an order.
  2. Orders received by 5:30 pm and accepted by us will be dispatched the same working day for next working day delivery (premium services and non-mainland UK deliveries incur extra charge). Delivery times are not guaranteed.
  3. For deliveries outside mainland UK, NI, Channel Islands and Isle of Man:
    1. You are responsible for arranging your courier or collecting goods from our premises;
    2. Orders may incur extra charges if over 94.5Kg in the UK or 70Kg internationally;
    3. If Photomart instructs a courier on your behalf, the delivery contract is between you and the courier;
    4. Photomart accepts no liability for courier performance;
    5. Payment for delivery will usually be collected by Photomart and passed on as your agent.

6. Warranties and Liabilities

  1. Photomart sells products with the benefit of the original manufacturer’s warranty. We do not manufacture the goods we sell.
  2. We accept liability only where the manufacturer’s DOA or warranty policy provides for refund, credit, repair, or replacement.
  3. No liability is accepted for defects due to wear and tear, misuse, negligence, abnormal conditions, failure to follow instructions, or unauthorised repair.
  4. All implied terms and conditions (except title) are excluded to the fullest extent permitted by law.
  5. If you believe an item is faulty, contact Customer Support. An RMA may be issued. Goods must be returned with RMA and inspected before replacement is issued.
  6. If we arrange collection, you must supply packaging photos to prevent disputes. No collection will be scheduled without them.
  7. Warranty claims: customer pays all shipping. Photomart accepts no liability for loss/damage in transit arranged by the customer. We do not reimburse shipping.
  8. If no manufacturer fault is found, item will be returned at your cost.
  9. No liability for economic or consequential losses (profit, goodwill, business, revenue etc.).
  10. Maximum liability: VAT-exclusive price of product, not exceeding insurance cover.
  11. Not responsible for delays due to force majeure (natural disasters, war, terrorism, strikes, etc.).
  12. Resellers are responsible for ensuring goods information is correct. You may not alter labels or represent Photomart/manufacturer without permission.
  13. Where liability is found under consumer law, it will not exceed the original purchase price.
  14. All goods/services are IP protected. You must not alter/remove branding. In the event of an IP claim, our liability is limited to purchase price.

7. Returns

  1. Photomart does not operate on a trial basis. Returns only if agreed in advance. Goods must be new, resalable. 15% restocking fee may apply. Delivery charges are non-refundable.
  2. Customised, special order, or personalised goods cannot be returned. Out-of-warranty repair returns must include completed returns form and packaging photos.
  3. Discrepancies or damage must be reported within 3 working days. RMAs must be returned within 3 days of issue.
  4. No refunds until inspection. Goods tampered with or incomplete will be rejected.
  5. Proof of purchase may be required.
  6. Software, memory cards, media only returnable if sealed. Opened software non-returnable unless faulty.
  7. This section excludes bespoke services (printing, design, albums etc.).
  8. Reasonable care required before return. Overuse may void refund.
  9. If agreed to repair/replace, you authorise necessary work.
  10. Photomart not liable for lost/damaged return shipments. Use tracked/insured.
  11. Bundled items non-refundable unless approved by management.
  12. Refunds initiated within 24–48h after goods received:
    1. Card refunds within 7 business days.
    2. PayPal refunds within 1 day.
  13. Items invoiced at zero value, free items, clearance goods excluded from return.

8. Branded Strut Mounts

  1. Branded strut mounts are customised items and cannot be returned or refunded unless they are faulty in manufacture.
  2. Artwork for branding must be sent to [email protected] in black and white vector/PDF format. Production will not begin until we have received confirmation of the artwork from the customer.
  3. Standard lead time is around 2 weeks from artwork approval. If you require your order sooner, an express service may be available at an extra charge. Lead times are estimates and may vary. If production takes longer than 2 weeks, no compensation or refund will be provided.
  4. Orders of 1,000 strut mounts or more include branding in one position and one branding block free of charge. Extra charges apply for:
    1. Branding in more than one location (£5 per box + £40 blocking fee)
    2. Orders under 1,000 mounts (£5 per box)
    3. Event/date-specific branding (£40 per block)
    4. Oversize branding (larger than 4" up to 8") (£2.50 per box)
    5. Additional branding blocks (£40 each)
  5. Branding can be positioned in L-Shaped, 45-Degree, Horizontal, or Back styles, subject to fit. Final position is confirmed at proof stage.
  6. Standard foil colours are Black, Silver, and Blind Embossing. Other colours may be available by request and may incur extra charges.
  7. Minimum order quantities apply and will be advised when placing the order. Payment is required in full before production unless agreed otherwise.

9. Software

  1. IP rights in any software remain with Photomart or licensors.
  2. You may not disassemble, reverse engineer, copy, or modify software without written consent.
  3. You are licensed to use the software only as described.
  4. You must not transfer or sub-license.
  5. Software returns are subject to Section 7.

10. Limitation of Liability

  1. Nothing in this Agreement affects statutory rights.
  2. Photomart not liable for direct or indirect losses (profits, data, contracts, goodwill, etc.) caused by events beyond our control or parts of the internet not under our direct control.

11. Printers for hire

  1. Printers are provided for weekly hire. Range/prices may change.
  2. Customers must know how to operate printers. Technician available Mon–Fri 9:30–17:00 for help. Printers are checked before dispatch.
  3. Customers accept responsibility for any damage. Costs may be deducted from deposit. If damages exceed deposit, further payment will be required.
  4. Customers are charged per print. Media cannot be purchased separately.
  5. If board damaged so print count unavailable, minimum charge of 100 prints applies.
  6. If delivered by DPD, customer must notify us immediately of any box damage or print faults.
  7. If collected/dropped off by customer, full responsibility for transit damage applies.
  8. No refunds for incompatibility with devices. Compatibility is customer’s responsibility.

12. Insolvency

  1. If the Customer becomes insolvent, bankrupt, ceases trading, or similar, Photomart may cancel the Agreement or suspend deliveries without liability. Any unpaid goods become immediately due and payable.

13. Matters beyond our reasonable control

  1. Photomart is not liable for breaches caused by events outside our control (Acts of God, extreme weather, war, strikes, government action, ISP failures, etc.).

14. Language

  1. In case of conflict between English and translations, English prevails.

15. Photomart Loyalty Points

  1. Available only to registered customers. 1 point = 1p. Photomart may change this value without notice.
  2. Points earned on orders of £50+ (ex VAT). Points not earned on shipping. Not transferable or redeemable for cash.
  3. Points expire after 2 years. Photomart may remove points if misuse suspected.
  4. Points usable only on online orders and outbound calls, not inbound calls.
  5. Payment providers may not accept points (e.g. takepayments). No compensation if not accepted.

16. Recycling Scheme

  1. Customers can earn £50 loyalty points for returning 10 used ribbons purchased from Photomart (UK only).
  2. DNP QW410 media: £25 per 10 ribbons.
  3. HiTi P310W, P322W, S420 ribbons not eligible.
  4. Ribbons must be purchased after 01/11/2022 and verified against account. Must be from a single account.
  5. Customers bear return costs. Returned ribbons will not be sent back.
  6. Points cannot be transferred or redeemed for cash.
  7. Discounted, bulk, or partnership purchases not eligible.
  8. All returns to: Photomart, Ellerman House, Redburn Industrial Estate, Woodall Road, Enfield, EN3 4LQ.
  9. Photomart reserves right to recycle without awarding points. Tree-planting pledges are additional and do not affect scheme terms.

17. Price Match

  1. We offer price match on identical products sold by authorised UK retailers, if in stock and available.
  2. Does not apply to auction sites, marketplaces, clearance, liquidation, special order, or promotional pricing.
  3. Competitor prices must be visible/verified. We may contact competitor to confirm.
  4. No refunds after purchase — price match only applied at time of purchase.
  5. Photomart may refuse price match at our discretion.
